Terms & Conditions

1. Consent to Terms and Conditions

 

Access to and use of the services of Jill Williams Destinations (True Creative, LLC dba Jill Williams Destinations, hereinafter “JW Destinations” and/or “our/we/us”) and our website is subject to acceptance of these Terms and Conditions (“Terms and Conditions”). By accessing, using, or obtaining any content, products, or services through our offices or website, you, the purchaser and/or traveler (“Customer” and “you/your”), agree to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions in their entirety, you must not use our services or website.

 

These Terms and Conditions govern the relationship between JW Destinations and you, the Customer. The document includes warranty disclaimers, liability exclusions, and restrictions of your rights. If you disagree with any part, please refrain from using our website or services.

 

No modifications to these Terms and Conditions may be made by any JW Destinations employee, advisor, representative, or agent unless expressly approved in writing by an authorized officer of JW Destinations.

 

2. Travel Documents and Identification Requirements

 

It is the Customer’s sole responsibility to obtain and carry a valid passport, visa(s), and any other documents required by applicable government regulations. All travelers, including minors, must comply with the U.S. Transportation Security Administration (TSA) and Department of Homeland Security (DHS) identification guidelines (see TSA Acceptable IDs).

     •       Passport Validity: Many countries require passports to be valid for at least six (6) months beyond your travel dates.

     •       Children and Minors: Additional documentation, such as parental consent forms, may be required for minors traveling internationally.

     •       Name Consistency: The name on your travel documents must exactly match the name on your airline ticket and other travel bookings.

 

Failure to meet these requirements may result in denied boarding or delayed entry. JW Destinations is not liable for any losses arising from noncompliance. Customers should review all supplier requirements on their websites.

 

3. Individual Entry and Exit Requirements

 

Each country has its own entry/exit requirements and policies regarding past criminal offenses. It is your responsibility to verify these requirements before travel, including contacting the relevant embassy for guidance (see U.S. State Department Travel).

 

JW Destinations does not guarantee visa issuance or entry approval and is not responsible for denied entry or financial losses resulting from noncompliance.

 

4. Risks and Safety

 

Travel to certain destinations may involve risks. Customers should remain informed of travel warnings and advisories issued by the U.S. Department of State, CDC, and other relevant organizations. These resources can be accessed at:

     •       State Department

     •       CDC

     •       TSA

 

JW Destinations does not warrant that travel to specific destinations is safe and shall not be held liable for damages or losses resulting from travel to such destinations. By booking travel services through JW Destinations, you assume the associated risks.

 

5. Use of Services

 

You must be at least 18 years old and have the legal authority to make travel bookings through JW Destinations. By using our services, you agree to:

     •       Be financially responsible for all travel bookings.

     •       Supervise usage by minors associated with your account.

     •       Provide accurate information during the booking process.

 

Separate supplier Terms and Conditions apply to reservations and purchases made through JW Destinations. You are responsible for understanding and complying with these supplier terms.

 

6. Payments and Cancellations

     •       Final Payment: Payments must be completed by the supplier’s deadline to avoid cancellation. Failure to pay on time may result in forfeiture of deposits.

     •       Cancellations: All cancellation requests must be made in writing. Cancellation penalties vary by supplier and are communicated at the time of booking. At a minimum, JW Destinations imposes a cancellation fee of 15% of the confirmed travel expenses booked.

 

Refunds for cancellations are limited and depend on the supplier’s policies. Certain bookings are nonrefundable.

 

7. Air Travel and Check-In

 

Unless specifically stated, airline reservations are not included in your travel package. Customers are responsible for making air travel arrangements and reconfirming flight schedules within 24 hours of departure.

 

Check-in is recommended as follows:

     •       Domestic Flights: At least 2 hours before departure.

     •       International Flights: At least 3 hours before departure.

 

JW Destinations is not liable for missed flights or schedule changes.

 

8. Currency Fluctuations

 

Prices are subject to change based on currency exchange rate fluctuations until final payment is made. Customers are responsible for any increase in costs due to exchange rate variations.

 

9. Travel Insurance

 

JW Destinations strongly recommends purchasing travel insurance to protect your investment. Insurance options may include:

     •       Trip cancellation and interruption.

     •       Medical emergencies and evacuation.

     •       Lost baggage and delays.

 

Insurance is not included in your travel package unless explicitly stated. JW Destinations employees are not authorized to provide advice on insurance coverage. Customers should consult directly with insurance providers.

 

10. Force Majeure

 

JW Destinations shall not be liable for delays or nonperformance caused by events beyond its reasonable control, including but not limited to natural disasters, acts of terrorism, strikes, pandemics, or government restrictions.

 

Refunds or itinerary modifications due to Force Majeure events are at JW Destinations’ discretion and subject to supplier policies.

 

11. Photographs and Media

 

JW Destinations reserves the right to use photographs or videos taken during your travel for promotional purposes. If you wish to opt out, you must notify us in writing before travel.

 

12. Limitations of Liability

 

JW Destinations acts solely as a booking agent for third-party suppliers (e.g., airlines, hotels, cruise lines). We are not responsible for the actions, errors, or omissions of these suppliers.

 

Our liability is limited to the commissions and fees JW Destinations has received for your booking in the twelve (12) months preceding any claim.

 

13. Governing Law and Arbitration

 

These Terms and Conditions shall be governed by the laws of the State of Alabama. Any disputes arising out of or relating to these Terms will be settled by arbitration in Houston County, Alabama, administered by the American Arbitration Association.

 

Class actions are waived. The prevailing party in arbitration is entitled to recover attorney fees and costs.

 

14. Privacy and Security

 

Your personal information will be treated in accordance with our Privacy Policy. Unauthorized access to secure areas of our website may result in legal action.

 

15. Modifications to Terms

 

JW Destinations reserves the right to update these Terms and Conditions at any time. Changes will take effect immediately upon posting on our website. Continued use of our services constitutes your acceptance of the updated Terms.
